Le tasse automobilistiche sono prescritte dal \u00a0terzo anno\u00a0successivo a quello in cui doveva essere effettuato il versamento. Quindi la ricevuta del bollo con scadenza dicembre 2011 va conservata fino al 31 dicembre 2015. Il periodo di pagamento \u00e8 gennaio 2012 dal quale si parte a contare tre anni. Questa la regola generale. A meno che nel triennio non sopraggiungano condoni, perch\u00e9 in tal caso vale la prescrizione breve del codice civile ossia 5 anni.<\/p>\n

Il credito della Regione, dunque, per un bollo non pagato, in base all’art.\u00a05 del D.l.953\/82 modificato dall\u2019art.3 del D.l. 2\/86 convertito nella legge 60\/86 per il recupero delle tasse dovute dal 1\u00b0 gennaio 1983 per effetto dell\u2019iscrizione di veicoli o autoscafi nei pubblici registri e delle relative penalit\u00e0, \u00a0si prescrive con il decorso del terzo anno successivo a quello in cui doveva essere effettuato il pagamento. La stessa regola vale per l’automobilista, che qualora si accorga di aver pagato per errore due volte il medesimo bollo, ha tempo tre anni (sempre dal periodo successivo di pagamento) per chiedere il rimborso.<\/p>\n

Per ultimo va detto che l’avviso di accertamento della Regione (beneficiaria del tributo) notificato nel triennio utile, interrompe la prescrizione. In questo caso i tre anni vanno ricalcolati dalla data di notifica. Infine, anche Equitalia, per il recupero del credito, ha tempo due anni da quando riceve l’incarico, per notificare la cartella esattoriale all’automobilista. Dopodich\u00e9 la tassa \u00e8 prescritta.<\/p>\n
