Secondo la suprema Corte, infatti, i beni sociali non sono beni in compropriet\u00e0 dei soci, bens\u00ec in titolarit\u00e0 della societ\u00e0, e dunque l&#8217;auto \u00e8 da considerarsi propriet\u00e0 di un terzo rispetto al conducente, e pertanto non confiscabile. La giurisprudenza civile richiamata dalla Corte ha avuto modo di precisare che &#8220;La societ\u00e0 in nome collettivo, ancorch\u00e8 non munita di personalit\u00e0 giuridica, \u00e8 soggetto di diritto distinto dalla personalit\u00e0 dei soci, in quanto costituisce centro autonomo di situazioni giuridiche ad esso immediatamente riconducibili anche in virt\u00f9 della capacit\u00e0 negoziale e processuale che l&#8217;art. 2266 c.c. &#8211; applicabile in virt\u00f9 del richiamo che l&#8217;art. 2293 c.c. effettua ad esso &#8211; attribuisce alla societ\u00e0&#8230;.&#8221; (Cass.
