La disposizione normativa ora citata prevedeva la irrogazione di una sanzione amministrativa pari ad euro 100,00 per chi non aveva ottemperato all&#8217;obbligo vaccinale.<\/p>\n<p>Ora, operando l&#8217;abrogazione ex nunc, ossia dal momento dell&#8217;entrata in vigore della norma abrogante, sia i procedimenti sanzionatori in corso, sia le sanzioni gi\u00e0 irrogate, sono rispettivamente interrotti e annullate. Viceversa, restano acquisite al bilancio dello Stato le somme versate.<\/p>\n<p>Sul punto, \u00e9 utile ricordarlo, pendono dei ricorsi giurisdizionali al T.A.R. per il Lazio che saranno discussi nel prossimo mese di febbraio 2025. Tuttavia, proprio in relazione alla scelta di non procedere con la restituzione delle somme pagate, si tratta di una valutazione del legislatore, il quale ha ritenuto che, con il pagamento dell&#8217;importo previsto dalla sanzione, il rapporto giuridico sia stato definitivamente chiuso.<\/p>\n<p>Se, invece, l&#8217;art. 21 del decreto-legge &#8220;milleproroghe&#8221; fosse stato formulato con effetto retroattivo, ossia a far data dall&#8217;entrata in vigore della norma che introduceva la sanzione amministrativa di 100,00 euro per chi non aveva eseguito, nelle modalit\u00e0 e nelle tempistiche previste, la vaccinazione contro l&#8217;agente virale Sars-Cov2, allora sarebbe stato possibile chiedere il rimborso di quanto versato, mancando il titolo giuridico per trattenere, da parte dello Stato, gli importi pagati.<\/p>\n<p><strong>Daniele Trabucco<\/strong><\/p>","protected":false},"excerpt":{"rendered":"<p>Il cosiddetto decreto-legge &#8220;milleproroghe&#8221; per l&#8217;anno 2025, adottato dal Consiglio dei Ministri in data 09 dicembre 2024, stabilisce (siamo in attesa del testo in Gazzetta Ufficiale), all&#8217;art. 21, l&#8217;abrogazione totale dell&#8217;art. 4 sexies del decreto-legge n. 44\/2021 convertito, con modificazioni, dalla legge ordinaria dello Stato 28 maggio 2021, n. 76.
